this is the site where you can register as a small batch manufacturer:

Registration is required to issue the CPSIA Certificates of Conformity for the company that do not have to test the product. See other posts for the details on eligibility.

I know this exempts some from 3rd party testing but am I wrong in thinking that we still have to label each garment with tracking information? What exactly is needed there?

tracking info and certificate of conformity are required for all products marketed to kids 12 and younger. 12 and under has to be Lead free, 3 and younger has to Phthalate adn Lead free.

yes it has to go on each garment. We stamp a tracking number with the web site under it. Once there, they can get all the lot numbers and production dates (which is what's required).

QUICK UPDATE:
After registering at the first site few days ago, I finally received the acknowledgement and further registration instructions. 'couple of clicks and another link (tab in the top right corner) gave me an option to register as the small batch manufacturer.
All together under a minute. Still waiting for my number, but this was pretty easy and painless. . .

Received my SBM reg number, now my question, as a small batch manufacturer do I need still need to label the clothing or just provide a Children’s Product Certificate? I did not see anything about labeling under the SBM. Can you direct me to the part that states I need to label the clothing?

Are we certain labeling is required? We don't individually package our shirts would that be a loop hole?

My understanding is that tracking labels are a completely different issue than certificates or the small batch exemption from testing, so it probably isn't addressed there.

section 103 regulates tracking labels.
Section 101 and 102 are dealing with lead and phthalates. Your exemption is only good for the 101 and 102.
there are no exemptions in our industry for the tracking labels.

Alright some light reading and I got it thanks! I just wanted to be sure the SBM # did not exclude that tracking label.
